A. GENERAL CONDITIONS RELATING TO THE FASTAFF WEBSITE AND APPLICATION1. The Fastaff system.
Fastaff specializes in connecting companies and temporary workers and has all the necessary authorizations to carry out these activities.
Through its website www.fastaff.ch (hereinafter “website”) and its Fastaff mobile application (hereinafter “application”), Fastaff facilitates the link between client companies and workers (hereinafter “workers”, “users” or “you”; to simplify reading, the masculine is used to designate all genders). This connection process (called “matching”) is largely automated.
Fastaff agents are responsible for promoting the website and application and assisting users of the platform. Each agent has a personal login.Use of the website or application is free for workers, client companies and agents.
These general terms and conditions (hereinafter "GTC") are considered accepted as soon as the user accesses the website or the application. The user explicitly accepts these GTC by checking the box provided when registering as a client company, worker or agent.
The provisions of the T&Cs do not only concern the use of the website or the application, but are also an integral part of all contractual relations with Fastaff.
1.1. Other applicable provisions

GENERAL PROVISIONS RELATING TO THE SERVICE RENTAL CONTRACT AND THE
MISSION CONTRACT
The provision of Fastaff services is subject to the following additional provisions:
The General Provisions on the Assignment Contract apply to users registered as workers on our website or application (hereinafter “workers”).
The General Provisions on the Service Rental Agreement apply to corporate customers registered on our website or application (hereinafter “corporate customers”).
(hereinafter referred to as “General Provisions Relating to the Mission Contract” or “General
Provisions Relating to the Service Rental Contract”)
2. Who can use the website and application and use the
services of Fastaff?
2.1. General
The website and the application are intended only for natural and legal persons,
partnerships and entities domiciled/headquartered in Switzerland.
The Website and the Application are not intended for persons subject to legal restrictions
prohibiting access to or use of our platform due to their nationality, domicile or for other
reasons. If one of the conditions is no longer met, Fastaff reserves the right to immediately
refuse access to the Website and the Application without obligation to justify its decision.
2.2. Provisions relating to workers
The user registering as a worker on the website or application is responsible for obtaining
the necessary documents and authorisations to work in Switzerland. By accepting an
assignment, the worker also confirms that he or she holds a Swiss passport or a type C
establishment permit, or a valid work permit at the time of the assignment.
If Fastaff discovers that, contrary to the information provided, these conditions are not met,it will immediately suspend the worker's access to the website and the application and inform the competent authorities.
Any change, including the withdrawal or non-renewal of the work permit, must be reported to Fastaff without delay. If the worker fails to comply with this obligation or shows up for a mission without a valid work permit, he or she will be required to pay a contractual penalty of CHF 2,000.– to Fastaff. In both cases, Fastaff reserves the right to claim any compensation for damages arising from this violation of these provisions.

2.3. Provisions relating to client companies
The user registering as a client company on the Fastaff website or application must have its registered office in Switzerland. The client company undertakes to comply with all collective labour agreements (hereinafter "CLA") applicable to its sector of activity. It is also required to comply with the legal provisions on labour law, data protection, and all applicable laws,ensuring that it has the necessary authorisations to carry out its activity.
If the client company fails to declare its membership of a CCT or provides incorrect or incomplete information, it will have to pay Fastaff a contractual penalty of CHF 5,000.–.
Fastaff reserves the right to claim any other damage resulting from non-compliance with this obligation.
2.4. Provisions relating to agents
An agent is an employee or agent of Fastaff. Any agent mandated by Fastaff who carries out more than 10 placements per year must declare that they are in possession of the necessary authorizations for the placement of labor.
Agents are required to treat confidentially all commercial data and information to which they have access in the course of their duties.
3. User Registration
All users must register on the website and/or application to access Fastaff's services. They will be assigned a username and password, which they must enter each time they log in.
Users must keep their identifiers safe and not disclose them to third parties. Fastaff declines all responsibility for any damage resulting from the disclosure or loss of these identifiers.
Fastaff reserves the right to block, remove, suspend or modify the website and/or the
application, in whole or in part, without notice. It cannot be held responsible in the event of
temporary or permanent unavailability of the site or the application, whatever the cause.
Users are responsible for their access to the Site and the Application and for taking all
necessary precautions to ensure their own safety. They must also ensure that all persons
accessing the Site or the Application via their connection comply with these Terms of Use.

4. Registration of workers and client companies by an agent
Any client company or worker registering through an agent must use the link provided by the agent,
which allows the agent to be identified.
Client companies and workers registered by an agent are assigned to that agent as long as their registration is active on the website and the application. A change of agent is possible only in the following cases:
• Agreement between client company/worker and agent;
• Serious breach of obligations by the agent;
• Existence of just cause.
Fastaff will decide on the possible change after hearing the parties concerned.
In the event of a breach by the agent of his obligations, the client company or the worker
must inform Fastaff using the contact form available on the site or application.
5. Refusal of access to the website or application
5.1. Principles
Users (workers, client companies and agents) agree to provide truthful answers and only
accurate information when registering. Fastaff reserves the right to carry out random
checks to ensure the reliability of the information provided.
If Fastaff finds that a statement is inaccurate, the user will be denied access to the website and
the application, and the contract will be deemed terminated as soon as possible. In addition,
Fastaff reserves the right to take legal action, including filing a criminal complaint.
Fastaff's system requires users to provide certain information or submit/upload documents
when registering or in other circumstances. Users undertake to respond to requests within
the specified time frame or, if no time frame is specified, within three business days. In the
event of non-compliance after a reminder, Fastaff reserves the right to refuse the user
access to the website and the application, which will result in immediate termination of the
contract.
Access may also be denied, and the contract terminated, if a worker or client company does not
respect the use of the link provided by an agent, recognizing that the registration is due to the e&orts
of this agent. However, suspension of access and termination of the contract will only be applied after
consultation with the parties concerned by Fastaff.
Furthermore, Fastaff reserves the right to refuse a user access to the website and the
application at any time and at its sole discretion, particularly if Fastaff's reputation is
threatened.
The user whose access to the website and the application is blocked is not entitled to any compensation.

5.2. Provisions relating to workers
Access to the website and the application is denied to a worker in the event of delinquency
in a client company, repeated non-compliance with the instructions of the client company, unexcused absence or serious criminal offences outside the company that compromise his suitability for placement by Fastaff. Fastaff may also deny access to a worker whose assessment is below a certain level.
5.3. Provisions relating to client companies
Access is denied to a client company if it is unable to settle Fastaff's claims on time, is subject to legal proceedings or bankruptcy, or has requested a suspension of composition.Fastaff reserves the right to request information on legal proceedings concerning a client company.
Access may also be denied if the client company's rating is below a certain level.
5.4. Provisions relating to agents
Access to the Website and Application is denied to an Agent if the employees or client
companies registered through the Agent's link repeatedly fail to fulfil their obligations, in
particular in the event of unjustified absences or non-payment to Fastaff.

6. Publication of content and communication with other users
6.1 Standard Rules for User Contributions
The following rules apply to all features of the Website and Application that allow users to upload content or communicate with other users:

6.2 Your Content
You confirm that you use all features to upload content to the Website and/or App and communicate with other users in accordance with the standard rules. You also agree to indemnify us for any loss or damage arising from your failure to comply with these obligations.
All content uploaded by workers can be viewed by client companies, and vice versa. As a worker, you can preview the data visible to a client company when searching for workers.
You retain all ownership rights to your content but grant us a worldwide, permanent, non-exclusive, royalty-free and transferable license to use, store and reproduce such content, as well as the right to transmit or share it with third parties in accordance with the above.We reserve the right to disclose your identity to anyone who claims that any content posted by you violates their copyright, intellectual property rights, or right to privacy.
You are not permitted to disclose to third parties the data of another user, unless such disclosure is necessary for evaluation purposes and subject to confidentiality obligations.
We assume no liability or responsibility to any third party for the content or accuracy of any contributions posted by you or other users on our website and/or application.
We reserve the right to remove any content you post if we believe it does not comply with the standard rules.
The opinions expressed by other users do not necessarily reflect our values. You are solely responsible for safeguarding your data.

7. Evaluation system
Fastaff has a rating system accessible to registered users, designed to ensure the quality of services for workers and client companies.
After each assignment is completed, both parties – workers and companies – have three days to provide an evaluation of their experience. Workers can evaluate the client company,and vice versa. Evaluations are based on criteria such as friendliness, punctuality, reliability,and professional skills. These evaluation criteria can be adjusted by Fastaff according to the needs of the platform.
Evaluations should be conducted honestly and reflect a sincere impression of the mission experience.
Challenging assessments:
Each user has the possibility to dispute a rating received within five business days after its publication on the website or application. The dispute must be submitted in writing and include specific reasons explaining why the rating does not meet Fastaff's objective criteria.
In such cases, Fastaff will attempt to find a solution in cooperation with the persons concerned to resolve the dispute.
Confirmation of evaluations:
If no objection is made within the time limit, the assessment will be considered approved and confirmed, without the possibility of subsequent modification.

B. FASTAFF DATA PROTECTION POLICY1. General
We inform users that by using the Fastaff website and/or application, their data is transmitted via a publicly accessible network. Fastaff may use data outside Switzerland or the European Economic Area (EEA), even if users and Fastaff are located in Switzerland. This transfer is always carried out in accordance with this Data Protection Policy (see point 5. THE DATA WE MAY RECORD ABOUT YOU for more details).
It is important to note that the security of data transmitted via the Internet, the Site or the
Application cannot be guaranteed against potential attacks. Exchanges between Fastaff and
users by e-mail, SMS, etc., are not encrypted, thus exposing the data to the risks of hacking
or virus attacks. However, Fastaff implements all reasonable physical, electronic and
procedural measures to protect your personal data, in accordance with the requirements of
data protection laws.
We recommend using the latest versions of browsers and regularly updated antivirus
software. It is also advisable not to open emails or attachments from unknown senders.
2. Protection of internal data transmission
All personal data is transmitted and stored securely within Fastaff. Fastaff takes the necessary measures to prevent any unauthorized access to personal data by third parties,except in the case of a legal obligation to disclose the data.
3. Collection of data for statistical purposes
Fastaff collects statistical data to continuously optimize its services. This data may include information on the number of hours worked by sector and profession, the ratio between hours worked and the number of workers, or missions not carried out due to lack of personnel. The data thus collected does not allow users to be identified individually and is therefore not covered by data protection laws.
4. Use of Location Data
We may collect and process your location data in real-time to provide location-based services. Location data may include GPS coordinates and network-based location data.
The app requests your permission to access your device’s location. You may deny or revoke this permission at any time through your device settings.
Location data is securely stored and processed in compliance with applicable laws and industry standards.
Location data is retained only as long as necessary for the stated purposes or as required by law.
We use third-party tools like Google Maps for location services. These tools have their own privacy policies that govern their data collection and usage practices. You can review Google's privacy policy here.
In accordance with legal requirements, Fastaff may be required to collect statistical data,only anonymously, within the framework of the observation of the labour market (art. 18,para. 2, LSE).

This Data Protection Policy governs the recording and transmission of personal data on our
website.www.fastaff.ch (hereinafter “Website”) or on the Fastaff application (hereinafter
“Application”). It explains to users of the platform or to workers (hereinafter “you”, for

passing it on to client companies or potential and current workers. Some of your personal

By submitting your information to us, you consent to its processing in accordance with this

uses of your data and offer you the opportunity to accept or refuse certain uses.
The Website and the Application contain links to third party websites. If you click on these
links, please note that these websites have their own data protection policies, and we do not accept any responsibility or liability for these policies and the processing of your information on these third party sites. Users may upload content (e.g., resumes, qualifications) as part of the hiring process. You remain the owner of this content, but we reserve the right to use it for the purposes agreed in this Policy.

If you are an employee and if circumstances justify it, we may record and process
confidential data such as your photo, your nationality, your physical and mental health, as well as, in certain cases, information concerning criminal offences committed or alleged.

If you are an employee, we record and process, as part of the hiring and registration
process, your biographical data (name, date of birth, gender), your contact details (postal
address, email address, telephone number and serial number of your mobile phone), as well
as information relating to your professional background, including:
- Photo (if you have uploaded one or more photos),
- Identity documents, work permit for Switzerland, social security number,
- Passport and/or visa information,
- Assessment data, job interviews, mobility,
- Driving license category, possible tattoos and/or piercings,
- Recommendations from former employers (if you have decided to provide them),
b. Additional checks
Depending on the job offer or the type of client company, we may also process additional
information, such as criminal record registrations, credit check results, or other checks.
c. Banking information
If you are a worker, we record and process your bank details for processing mission-related payments.
d. Benefits and compensation
If you are an employee, we record and process data relating to any benefits that we may
manage on your behalf, such as daily sickness benefits, in accordance with legal or
contractual provisions.

application, whether when registering, posting content or requesting services. Information

We advise you not to upload information that you do not wish to share with other users. Fastaff disclaims any liability for the use of this data by other users.

8. DISCLOSURE TO THIRD PARTIES AND JUSTIFICATION FOR THESE
TYPES OF USES
8.1 Sharing of data with client companies and authorized third parties If you are a worker and have been assigned to a client company, we will transfer your personal data, including your identity and suitability for the role, to the company for the purpose of carrying out the assignment. The client company is solely responsible for protecting this data and must comply with all data protection laws and regulations. We accept no liability for the company’s acts or omissions in processing your personal data.Workers are advised to review the client companies’ data protection policies to understand how their data is processed.
If you are an official representative of a client company, we will forward your personal data
(identity and contact details) to the assigned worker. In addition, we may authorize certain
selected third parties to use your personal data exclusively for the purposes set out in point
6, ensuring the same protection measures as ours. These third parties include our group
companies, cloud service providers and suppliers that we use to provide our services. You
will find a list of these third parties on our website or app.
